Ok long story short I wont use names just letters of their first names

Friend J

My friend A had to move so she moved to friends T&J's place. A paid no bond and was just am approved applicant A just got a new place and moved now Friends T&J are saying she broke the lease and they are taking action is this right? even though A didn't pay bond can T&J take action on A? I looked at the RTA site and couldn't find anything

I told A just to go to the real estate and say that she has moved out but im not 100% sure

If her name isn't on the lease I don't think they can do anything.

And if she didn't pay a bond what 'action' are they taking? It obviously isn't withholding her bond?

Why are they annoyed with her? Is it just that they got used to having an extra person to split costs with?
Has she paid her share of the bills/owes them money for rent?

If she is on the lease they can, if she is not they can't. Simple, so ask her if she is on the lease.

If she was an approved applicant then she would have been added to the lease in which case she has a responsibility to keep paying rent until the other tenants are able to find another person to replace her. Which is only fair in my opinion.

I can't see why T & J are concerned about, they were managing before A moved in weren't they. If a signed a document saying that she would live there for 6 months but only stayed 2 then perhaps she is breaking a lease. Perhaps your friend should contact the residential tenancies association (or similar) in your state. Before calling them, she needs to go to the real estate and obtain copies of any documents that they have with her name on them and take it from there.

Not nessisaraly(?) , when Dh and I were renting, my sister moved in with us for a year. We got approval from the RE. She was never added to the lease.

thanks for the replys she didn't pay bond and she is paying them 1/2 the rent till she moves out compleatly I'm going with her to get her stuff exept her bed and her DS's cot, and going to the real estate.

Yes but it depends on what T&J did with the actual lease.

A needs to call the REA and just double check that she wasnt added to the lease. If she was added then she also needs to call the utilities and make sure she wasnt added on there either.

Does she have receipts of paying 1/2 the rent (bit stiff to be honest)? If so, and she wasnt added on the lease, then they have nothing to claim from her. - unless they are expecting her to pay her share of the utilities?

Sounds like a very empty threat... really not sure how they are going to enforce / take action???

She may have more on them if she is not a party to the bond as if on lease then she would be entitled to the bond as well... REA may have added her name

really I think its a bluff because they are cranky she is moving out and they are losing 1/2 rent being paid....

Tell her to not stress, ignore them and see what happens if anything... people DO love to threaten all sorts especailly if they love american tv... not quite the same here !!
